These Terms of Use ("Terms") are a legal agreement between you and Vibel Team ("Vibel," "we," "us," or "our") governing your access to and use of the Vibel mobile application and related services (the "Service").
By creating an account, downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) Eligibility (17+)
The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.
2) The Service
Vibel provides an entertainment and educational experience related to racing, including chatting with racing characters, interactive challenges and knowledge tests, and community-oriented features.
The Service may change over time, and we may add, modify, or remove features at any time.
3) Accounts
- Provide accurate information (such as your name/username/email as applicable)
- Maintain and update your information as needed
- Keep your login credentials confidential
- Notify us promptly of unauthorized access
You are responsible for all activity under your account.
4) Acceptable Use
You agree not to misuse the Service. Prohibited conduct includes:
- Illegal use or violations of applicable law
- Harassment, threats, defamation, or abuse
- Submitting content that is unlawful, harmful, hateful, or infringes others’ rights
- Unauthorized access attempts, disruption, malware, or exploitation
- Scraping or reverse engineering except where prohibited by law
- Spam or deceptive behavior
5) User Content
You may submit content such as text, messages, and (where enabled) images ("User Content"). You retain ownership of your User Content. You grant Vibel a limited license to host, store, reproduce, process, and display User Content only as needed to operate, provide, maintain, and improve the Service and to enforce these Terms.
You represent that you have the rights to submit the User Content and that it does not violate law or third-party rights.
6) AI/Automated Responses and Outputs
Some features may generate automated responses (for example, character chats) or automated results in challenges. Outputs may be inaccurate, incomplete, or not suitable for your specific needs. You are responsible for how you use any output.
You must not rely on the Service for professional advice (including medical, legal, or financial advice).
7) Privacy
Our collection and use of personal information is described in the Vibel Privacy Policy.
8) Purchases and Subscriptions (If Applicable)
If paid features are offered, pricing and terms will be shown at the point of purchase. Payments may be processed through the platform provider (such as Apple). All sales are final except where required by law or platform rules.
9) Intellectual Property
The Service (including software, design, logos, and content provided by Vibel) is owned by Vibel or its licensors and is protected by intellectual property laws. You may not use our trademarks without written permission except as allowed by law.
10) Third-Party Services
The Service may interact with third-party services or content. We are not responsible for third-party services, and your use of them may be governed by their terms and policies.
11) Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBEL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
To the maximum extent permitted by law, Vibel’s total liability will not exceed the amount you paid (if any) to Vibel for use of the Service in the 12 months before the event giving rise to the claim, or USD $100 if you paid nothing.
13) Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if necessary to protect the Service or others. Provisions that should survive will survive.
14) Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a new effective date. Continued use after an update means you accept the updated Terms to the extent permitted by law.
15) Governing Law and Dispute Resolution (Binding Arbitration)
These Terms are governed by the laws of Vibel Team’s principal place of business, without regard to conflict of laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration, except where prohibited by law. The arbitration will be conducted on an individual basis; class actions are not permitted to the extent allowed by law.
16) Miscellaneous
- Entire agreement: these Terms are the entire agreement regarding the Service.
- Severability: if a provision is unenforceable, the remainder remains in effect.
- No waiver: failure to enforce is not a waiver.
- Assignment: you may not assign these Terms without consent; we may assign in a business transfer.
